1. Scope of Application
These general terms and conditions apply to all business relationships between Neri and the customers who make purchases through the online shop of neritextil.ch or through direct sales at the workshop at Stollbergstrasse 6, 6003 Lucerne. By placing an order in the online shop, customers agree to the application of these terms. Deviating conditions from customers are only valid if Neri has explicitly agreed to accept these terms and another agreement has been made.

3. Conclusion of Contract
The contract is concluded as soon as the product is ordered and the customer has received an order confirmation via email. The order is accepted when Neri sends an order confirmation by email or when the ordered goods are delivered (including delivery note). The contract may also be concluded when purchasing in person at the workshop.

4. Product Offer
The products listed in the online shop and their quantities are continuously updated. The colors of the products are depicted as accurately as possible in the online shop. Due to different monitor settings, there may be slight color deviations in the products shown in the images. Any changes to the product range, such as patterns and colors of the fabrics, can be adjusted and modified by Neri at any time.

5. Prices
The prices are quoted in Swiss Francs. The statutory VAT of 8.1% is included in the price.

6. Shipping Costs
Shipping within Switzerland: 9 CHF. For orders and delivery addresses outside Switzerland, additional costs such as customs duties and taxes may arise. Shipping costs are calculated flat-rate and will be displayed during the order process. When shipping abroad, customs duties and fees may apply, which are beyond Neri's control. These costs are to be fully borne by the recipient.

7. Payment
The available payment options are payment by invoice or payment in advance. Payment by invoice must be made within 30 days after receiving the product. For preorders of new productions, 30% of the total price is required upon order placement. The remaining 70% must be paid before the goods are shipped.

8. Delivery
Delivery of fabrics is made exclusively within Switzerland and the EU. Fabrics that are in stock will be shipped within 3 days after the order is placed. For fabrics that are out of stock and pre-ordered, the production date will be indicated on the website. In such cases, the production date and the delivery date will be communicated by email as soon as they are confirmed. By arrangement with Neri, all fabrics can also be picked up and purchased directly at the workshop in Lucerne.

9. Product Features and Care Instructions
Linen is a natural product with associated structural characteristics and deviations. Due to the natural nature of the material, the linen fabric may have irregular yarn thickening, knots, lighter and darker fiber parts. The colors and material properties, such as texture, softness, and drape of the fabrics, may slightly vary depending on the batch of linen. The plant-dyed threads and fabrics may change slightly over time and after repeated washing. This is not a defect but a product feature. Depending on the intensity of everyday use and the choice of different detergents, the appearance may lighten, the material texture may become softer, and the fabrics may shrink. The care instructions provided on the website must be followed. The fabrics are woven from fine yarns in various weaves, and gentle handling and washing are required. Overloading the washing machine, high spin speeds, chlorine bleach, or stain removal agents must not be used, or warranty claims will be voided. Products must not be washed while folded. Failure to follow the provided care instructions will result in the loss of warranty claims.

10. Warranty
The images of the products offered in the webshop are symbolic, and deviations may occur due to browser representations. The care instructions must be followed. Damages or defects caused by proven incorrect care cannot be refunded by Neri. Neri guarantees, according to legal requirements, that the products are free from defects at the time of delivery, meaning the products possess the agreed or generally assumed properties. In case of a defect, customers can choose between a replacement or a refund of the amount.

11. Retention of Title
The delivered goods remain the property of Neri until full payment is made.

12. Return/Right of Withdrawal
It is possible to return or exchange the product within 14 days. Exchange is only possible with products available in stock. Only flawless fabrics will be accepted for return unless otherwise agreed with Neri. For returns, the transport costs are borne by the customer. The purchase price will be refunded, and in case of an exchange, the price difference will be settled. Before returning the item, customers are requested to contact Neri by email, including the reason. The products must then be returned in the original packaging with the delivery note included in the package to the specified address. All returns will be inspected by Neri. Purchased products must not show signs of use. Returns will be rejected if:

• Signs of use are visible, the product is dirty or damaged.
• The product has been damaged during transport.
  Important! For international returns (outside Switzerland and Liechtenstein), any customs duties, taxes, or import charges, as well as the original shipping costs, will not be refunded.

13. Liability for Damages
Neri is only liable for damages related to the fulfillment of the contract if intentional or grossly negligent behavior is proven. This does not apply in the case of personal injuries. Claims for consequential damages, particularly for damage caused by discoloration of the goods or associated items, are excluded.

14. Data Protection
Personal data of the customer will be collected and processed exclusively to process the order and in accordance with the applicable data protection regulations. For more information on data processing, please refer to the (link to the privacy policy).

15. Final Provisions
Swiss law applies to the contract, with the jurisdiction being in Lucerne.
